A Florida man known as “Lieutenant Dan” on TikTok has been arrested following a viral stint after surviving Hurricane Milton on his boat.

Joseph Malinowski, a one-legged sailor, gained online fame for weathering the storm at sea. His TikTok username references the war veteran character from Forrest Gump. However, the 54-year-old found himself in trouble with Tampa police on Friday, October 18, for refusing to relocate his boat from Bayshore Linear Park due to a health hazard, according to NBC.

Authorities reported that Malinowski lacked the proper records for waste disposal on his vessel and did not have a functional marine sanitation device. His arrest notice even listed his occupation as “TikTok Star,” according to reports.

Tampa Police Department public information officer Verliz Williams stated: “Malinowski informed officers that he did not have an accessible marine sanitation device aboard his unregistered vessel and did not have a record of proper disposal of waste, creating a public health hazard. He was instructed to leave the park; however, he was found to be still there this morning, even after numerous warnings.”

On his TikTok page, Malinowski shared that he lost his leg in a car accident at the age of 16.

When explaining why he ignored evacuation orders during the category five storm, Hurricane Milton, he said: “The safest place to be is on a boat in a flood. We learned that with Noah. Everyone that stayed on land drowned. Noah and the animals lived. I’m not worried.”

He added, “My life, this is nothing compared to what I’ve been through. This doesn’t scare me. This is not even a minor inconvenience because all that’s going to happen is everyone is going to get wet, but I’m going to be fine because I’m in a boat that floats.”

According to The Orlando Sentinel, this isn’t Malinowski’s first brush with the law. He previously served a one-year prison sentence for “punching a police officer in the nose,” and just last year, he was accused of setting a park bench on fire and splashing gasoline on a woman.

“She feared for her life due to the potential for the gasoline to ignite due to her holding an ignited cigarette,” the deputy noted in his arrest report.
