Get ready to start the countdown for Erik and Lyle Menendez … the brothers could be out of prison before Christmas, as reported by TMZ.

According to sources with direct knowledge, the Menendez brothers’ attorneys are set to appear in court on December 11, where a judge will decide if they’ll be released immediately after.

The hearing date was arranged during a recent meeting between Erik and Lyle’s defense team, the prosecution, and the newly assigned judge for their case, Michael V. Jesic of Los Angeles County Superior Court.

It was previously reported that Erik and Lyle’s attorney, Mark Geragos, plans to request that the judge reduce their conviction from murder to manslaughter.

The D.A.’s Office has indicated they’re open to the adjustment, and if the judge approves, the brothers could be freed immediately, as they’ve already served three times the maximum sentence for manslaughter.

There are two other potential paths to freedom for Erik and Lyle. Los Angeles County D.A. George Gascón has requested resentencing, proposing the judge replace their life sentences without parole with a sentence of 50 years to life. This would make the brothers eligible for parole immediately. However, the parole board would need to be involved, and a decision could take up to six months.

The third option is clemency, which would require action from California Governor Gavin Newsom. Geragos has confirmed he’s submitting a clemency petition, and if Governor Newsom commutes their sentence, Erik and Lyle would walk free.

While there are multiple factors at play, things are progressing quickly, making it likely the brothers could be home in time for the holidays. However, the judge could also choose to take the case under advisement after the December hearing, which could lead to further delays.
